Adrian Peterson En Banc Request: Two weeks ago the Eighth Circuit Court of Appeals handed out another devastating decision to NFL Players (PDF), overturning the lower court’s decision and reinstating Adrian Peterson’s previously vacated discipline in a 3-0 vote. We broke down the Peterson defeat earlier, including a detailed account of AP’s options going forward.
One of those options, similar to what Tom Brady unsuccessfully attempted in Deflategate, is seeking an en banc rehearing of the decision. Peterson has the option of asking the three-judge panel who decided the appeal to rehear the case and ask all of the active Eighth Circuit judges to consider the appeal. If Peterson and the NFLPA decide to go this route, the request is due on Thursday (8/18). Rehearing requests are rarely granted, and since this was a 3-0 opinion, this one is even more of a long shot.
Darren Sharper Sentencing: After a federal judge rejected former NFL Safety and NFL Network analyst Darren Sharper’s nine-year sentence as too lenient, he is due back in federal court on Thursday (8/18) for another sentencing hearing. According to federal guidelines, Sharper now faces 15-20 years for drugging and sexually abusing as many as 16 women in Arizona, California, Nevada, and Louisiana. Sharper has pleaded guilty in courts in each state.
The two co-defendants in Sharper’s case, Brandon Licciardi and Erik Nunez, recently pleaded guilty to several charges, including conspiring with Sharper to drug women. The plea agreements call for a 17-year sentence for Liccardi and 10-year sentence for Nunez, although a federal judge still must approve the agreements.
